This article proposes a reflection on the persistence of Nazi jurisdictional models in contemporary legal theory, briefly comparing the work of authors such as Wolf, Larenz, Schmitt, Dworkin and Alexy. It aims to demonstrate the authoritarian and radically undemocratic character of certain theoretical constructions used in adjudication, particularly in Brazil. For this purpose, three representative judicial decisions from 2016 are analyzed, highlighting typical structural features of Nazi legal theory which remain accepted by current legal theory, such as the disregard for (...) legality, the personification of the community as judge and the appeal to social values which are taken as self-evident. This is a book review of "The Metaphysics of Sensory Experiencie" by David Papineau.

Este estudo teve como objetivo comparar os perfis da síndrome de burnout, em professores da Educação Básica, por sexo. Foi realizado um estudo transversal com amostra de 184 participantes. Foram utilizados o Questionnaire Burnout Clinical Subtype e o questionário sociodemográfico. Os resultados apontaram que não houve diferenças estatisticamente significativas para os perfis “Frenético”, na comparação ao sexo. Por outro lado, as análises sinalizaram uma diferença estatisticamente significativa para o perfil “Subdesafiado”. A ausência de diferença no perfil Frenético, em relação ao (...) sexo, se restringe às circunstâncias laborais de ensino experimentadas por professores e professoras, mas não traz explicações conclusivas sobre a experiência das professoras, no tocante ao conflito, manejo e às experiências da interface ensino/tarefas domésticas, durante a etapa de emergência em saúde pública. No que se refere ao perfil subdesafiado, a diferença encontrada entre homens e mulheres pode ser oriunda do estilo de manejo emocional e cognitivo, estabelecido pela cultura, para os homens, em diversas instâncias sociais. No tocante ao perfil desgastado, as diferenças, por sexo, em suas experiências de esgotamento foram equalizadas pelos desafios de lecionar. (shrink)

Jean Jacques Rousseau (1712-1778) ne cesse de fasciner ses lecteurs, par les controverses internes de ses ecrits. Dans une societe mondialisee, confrontee regulierement aux extremismes religieux qui tentent d'imposer leur vision du monde par la violence, peut-on encore entendre son verdict dans les Lettres ecrites de la Montagne : "La Religion est utile et meme necessaire aux Peuples"? Devant les theories de la laicisation, developpees dans une perspective de secularisation a sens unique, orientees vers l'expulsion de la religion de la (...) sphere publique, la relecture de la pensee politique de Rousseau est indispensable pour elaborer un contrat social acceptable par tous. La contribution du philosophe de Geneve a une analyse critique du theologico-politique, et son opposition aux perspectives atheistes de ses contemporains, est d'un grand interet dans le debat autour de la laicite des Etats postmodernes. En effet, le paradoxe, qui traverse la pensee de Rousseau, trouve son point culminant dans sa controverse avec les encyclopedistes sur le lien entre la politique et la religion. Plus que tout autre philosophe des Lumieres, Jean Jacques Rousseau eclaire la comprehension des defis que posent a notre temps la relation du politique et du religieux. (shrink)

Das Crises às possibilidades da Educação Superior no Brasil: uma leitura a partir de Hannah Arendt Resumo: O texto procura entender os pressupostos da educação superior no Brasil e faz considerações sobre seus limites e potencialidades à luz de Hannah Arendt. Segundo Hannah Arendt, a crise da educação remete-se a uma crise de estabilidade de todas as instituições políticas e sociais. E para o enfrentamento dessa crise, Hannah Arendt sugere reconsiderar a crise da modernidade para se repensar criticamente o papel (...) da educação no mundo contemporâneo. De fato, sua reflexão assevera que a educação está entre as atividades mais elementares e necessárias da sociedade humana, e, por isso, tem de ser continuamente repensada em função das transformações do mundo no qual nascem novos seres humanos. Hannah Arendt, questiona e faz pensar como que a crise da e na educação impede todo desenvolvimento de tarefas e dinâmicas que ajudem, especialmente aos estudantes (em qualquer área de conhecimento) a possuírem e produzirem um conhecimento que leve a um enfrentamento de situações críticas do quotidiano. According to Hannah Arendt, the crisis in education refers to a crisis of stability of all political and social institutions. And to envisage this crisis, Hannah Arendt suggests reconsidering the crisis of modernity to critically rethink the role of education in the contemporary world. In fact, her reflection asserts that education is among the most fundamental and necessary activities of human society, and, therefore, it must be continually rethought considering transformations in the world in which new human beings are born. Même s’il existe peu d’études sur la vie d’un homme se mariant avec une femme divorcée qui a des enfants, son rôle dans cette nouvelle structure est fondamental, à la fois pour l’ajustement et la qualité de la relation conjugale et familiale. Afin de mieux comprendre l’expérience de ces hommes au Brésil, nous avons réalisé à São Paulo une étude portant sur cinq hommes âgés entre 27 et 43 ans. Ils ont été interrogés individuellement sur leur expérience de vie commune (...) d’au moins deux ans avec des femmes ayant des enfants mineurs, et appartenant à la classe moyenne urbaine. Les témoignages ont été organisés selon les principaux thèmes identifiés dans notre étude, à savoir: complexité de la vie en famille, conjugalité, parentalité et rapport avec l’ex-mari. On a vérifié aussi que l’homme a réalisé son projet amoureuxconjugal avec les enfants de sa femme, parce que c’est autour d’eux que se concentre la majeure partie des difficultés conjugales. Les témoignages recueillis permettent aussi d’identifier des aspects de vulnérabilité et de protection qui mériteraient une autre étude plus approfondie. (shrink)

In feminist media studies, the growing body of research on media production has indicated that journalism remains divided along gender lines. The purpose of this study is to address the lack of relevant multi-method research on gender inequality in journalism. To assess the structural position of women in the journalistic workforce, the authors conducted a large-scale survey of journalists in Belgium. The survey results were explored in more depth by conducting qualitative interviews with 19 female journalists. The analysis confirms the (...) existence of all traditional barriers that women journalists experience. The added value of this study is that it enumerates several additional difficulties, and offers insight into the strategies that the respondents use to deal with gender-related career obstacles. These strategies were associated with the degree of flexibility in the newsroom for journalists with children, the choice to work part-time or freelance, and the use of new communication technologies. Consider a cat on a mat. On the one hand, there seems to be just one cat, but on the other there seem to be many things with as good a claim as anything in the vicinity to being a cat. Hence, the problem of the many. In his ‘Many, but Almost One,’ David Lewis offered two solutions. According to the first, only one of the many is indeed a cat, although it is indeterminate exactly which one. According to the (...) second, the many are all cats, but they are almost identical to each other, and hence they are almost one. For Lewis, the two solutions do not compete with each other but are mutually complementary, as each one can assist the other. This paper has two aims: to give some reasons against the first of these two solutions, but then to defend the second as a self-standing solution from Lewis’s considerations to the contrary. Th e simple proposal about rigidity for predicates can be stated thus: a predicate is rigid if its canonical nominalization signifi es the same property across the different possible worlds. I have tried elsewhere to defend such a proposal from the trivialization problem, according to which any predicate whatsoever would turn out to be rigid. Benjamin Schnieder (2005) aims fi rst to rebut my argument that some canonical nominalizations can be fl exible, then to provide fi ve arguments to the (...) eff ect that they are all rigid, and fi nally to propose a general explanation of why they are all rigid. I show fi rst why my argument has not been rebutted, then why Schnieder’s fi ve arguments for their rigidity all fail, and fi nally why the alleged “explanation” cannot be such, as the facts alluded to are neutral with respect to the rigidity or fl exibility of the nominalizations. Let Kilimanjaro(+) be the body of land constituted, in the way mountains are constituted by their constituent atoms, by the atoms that make up Kilimanjaro together with Sparky, and Kilimanjaro(–) the one constituted by those other than Sparky. On the one hand, there seems to be just one mountain in the vicinity of Kilimanjaro. On the other (...) hand, both Kilimanjaro(+) and Kilimanjaro(–)—and indeed many other similar things—seem to have an equal claim to be a mountain: all of them exhibit the grounds for something being a mountain—like being an elevation of the earth’s surface rising abruptly and to a large height from the surrounding level,1 or whathaveyou—; and there seems to be nothing in the vicinity with a better claim. Two paradigms have guided emotion research over the past decades. The dual-system view embraces the long-held Western belief, espoused most prominently by decision-making and social cognition researchers, that emotion and reason are often at odds. The integrative view, which asserts that emotion and cognition work synergistically, has been less explored experimentally. However, the integrative view (a) may help explain several findings that are not easily accounted for by the dual-system approach, and (b) is better supported by a growing body of (...) evidence from human neuroanatomy that has often been overlooked by experimental neuroscience. Artificial intelligence plays an important role and has been used by several countries as a health strategy in an attempt to understand, control and find a cure for the disease caused by Coronavirus. These intelligent systems can assist in accelerating the process of developing antivirals for Coronavirus and in predicting new variants of this virus. For this reason, much research on COVID-19 has been developed with the aim of contributing to new discoveries about the Coronavirus. However, there are some epistemological (...) aspects about the use of AI in this pandemic period of Covid-19 that deserve to be discussed and need reflections. In this scenario, this article presents a reflection on the two epistemological aspects faced by the COVID-19 pandemic: The epistemological aspect resulting from the use of patient data to fill the knowledge base of intelligent systems; the epistemological problem arising from the dependence of health professionals on the results/diagnoses issued by intelligent systems. In addition, we present some epistemological challenges to be implemented in a pandemic period. (shrink)

According to Jackson, Pettit & Smith , “restricted particularism” is not affected by their supervenience-based consideration against particularism but, they claim, suffer from a different difficulty, roughly that it would violate the platitude about moral argument that, in debating controversial moral issues, a central role is played by various similarity claims. I present a defense of “restricted particularism” from this objection, which accommodates the platitudinous character of the claim that ordinary participants in conversations concerning the evaluative are committed to descriptive (...) similarities and differences being relevant in the way described by Jackson, Pettit and Smith, to moral similarities and differences. My defense exploits a presuppositional component congenial to response-dependent proposals such as Lewis’s. (shrink)

Reponse to Peter Milne (2005)'s argument agaist maximalism about truthmaking.

According to the simple proposal about rigidity for predicates, a predicate is rigid (roughly) if it signifies the same property across the relevant worlds. Recent critics claim that this suffers from a trivialization problem: any predicate whatsoever would turn out to be trivially rigid, according to the proposal. In this paper a corresponding "problem" for ordinary singular terms is considered. A natural solution is provided by intuitions concerning the actual truth-value of identity statements involving them. The simple proposal for predicates (...) is then defended, by exploiting corresponding intuitions concerning statements involving their nominalizations, in an analogous manner. (shrink)

In the recent literature on contextualism and relativism, one often finds disputes as to which kind of consideration would be relevant for positing a feature of a context as a parameter in the ‘‘circumstance of evaluation’: via the presence of an operator in the language which shifts that feature (Stanley) or by being a feature of a context with respect to which the truth of ‘‘propositions’’ expressed in the context is relative (McFarlane). This kind of dispute arises from two different (...) independent roles that elements in ‘‘circumstances of evaluation’’ are sometimes assumed to have. I distinguish indices from points of evaluation, and motivate its significance in the debate. (shrink)

What different relativist claims about a given domain are to be distinguished? Which of them is best placed to account for intuitive facts about disagreement in that domain? In a recent paper in this journal, ‘Indexical Relativism versus Genuine Relativism’ (2004), Max Kölbel distinguishes two forms of relativism, andargues that one of them, indexical relativism, faces problems in accounting for disagreement. In the first part of this discussion I present my own taxonomy of relativist positions in a given domain, which (...) is based on David Lewis’s 1980 essay, and I compare it with Kölbel’s and other recent suggestions. In the second part, I argue that the presuppositional defence of indexical relativism against related objections that I have elaborated elsewhere is also effective against Kölbel’s recent charges. Argumento en contra de la corrección exegética y de la verdad de esta tesis.Kripke famously argued that the illusion of contingency cannot be explained away, in the (...) case of consciousness, in the way it is explained away in the rest of familiar cases of necessary aposteriori statements. In a recent paper, Pérez Otero (2002) argues that there is an alternative way of explaining it a way, in terms of mere aposteriority. OVER THE PAST FEW DECADES many attempts have been made to defend Hegel’s philosophy against those who denounce it as crypto-theological, dogmatic metaphysics. This was done first of all by foregrounding Hegel’s indebtedness to Kant, that is, by interpreting speculative science as a radicalization of Kant’s critical project. This emphasis on Hegel’s Kantian roots has resulted in a shift from the Phenomenology of Spirit to the Science of Logic. Robert Pippin’s Hegel’s Idealism: The Satisfactions of Self-Consciousness can be considered as (...) having made one of the most influential contributions to this shift. Pippin’s “nonmetaphysical” interpretation of Hegel rightly contends that the Science of Logic does not pertain to a reality existing independently of thought, but to “thought’s attempt to determine a priori what can be a possible thought of anything at all.” For Pippin this entails that Hegel should be regarded as appropriating “Kant’s claim about the ‘self-conscious,’ ultimately the ‘spontaneously’ self-conscious, character of all possible experience.” I agree with Pippin that one cannot understand Hegel unless “one understands the Hegelian investment, the original engagement with Kant’s critical philosophy.” I would hold, however, that Pippin’s interpretation of this engagement threatens to lose sight of the proper achievement of Hegel’s philosophy. By arguing that the unity of self-consciousness constitutes the “original source of Hegel’s hermetic claim about thought’s self-determination,” Pippin to my mind ignores, first, that Hegel takes the Kantian notion of self-consciousness to be nothing more than the concrete manifestation of the pure concept and, second, that Kant’s transcendental philosophy, though radically critical of the dogmatic metaphysics of his day, does all but abandon the possibility of a critical ontology. Defending Hegel against his antimetaphysical critics, Pippin is right in taking Hegel into the Kantian camp, but he does this by sacrificing the question as to the possibility of ontology, a question I believe to be pivotal for both Kant and Hegel. There are certain metaphysically interesting arguments ‘from vagueness’, for unrestricted mereological composition and for four-dimensionalism, which involve a claim to the effect that idioms for unrestricted quantification are precise. An elaboration of Lewis’ argument for this claim, which assumes the view of vagueness as semantic indecision, is presented. It is argued that the argument also works according to other views on the nature of vagueness, which also require for an expression to be vague that there are different admissible alternatives of (...) the relevant sort, such as epistemicism, as defended by Williamson. Recent attempts to resist the argument are discussed and rejected. (shrink)

According to the simple proposal, a predicate is rigid iff it signifies the same property across the different possible worlds. The simple proposal has been claimed to suffer from an over-generalization problem. Assume that one can make sense of predicates signifying properties, and assume that trivialization concerns, to the effect that the notion would cover any predicate whatsoever, can be overcome. Still, the proposal would over-generalize, the worry has it, by covering predicates for artifactual, social, or evaluative properties, such as (...) 'is a knife,' 'is a bachelor,' or 'is funny.' In defense, it is argued that rigidity for predicates as characterized plays the appropriate theoretical role, and that the contention that "unnatural" properties are not to be rigidly signified is ungrounded. Upon her release, Mary gains new knowledge aligned with B-type materialism and property dualism, even though she already possesses knowledge of all the facts and truths related to color and color vision during her time in captivity. I argue that this “cognitive progress” can only be accounted for by the acquisition of a new nonconceptual representation of the color red upon her release. Independently of any concepts, this acquisition already enables her to discriminate all sorts of shades of color within (...) her environment. However, the existence of nonconceptual representations, by itself, is not enough to specify the type of knowledge Mary acquired, obviously. We must add two additional conditions. Firstly, the acquisition of these nonconceptual representations must enrich Mary’s preexisting physical concept of red. Assuming that concepts are mental files, the enrichment takes the form of housing information in analog format, like pictures of the color red. Secondly, by utilizing these enhanced concepts by analog information, Mary can achieve an introspective propositional knowledge. She learns the truth of the crucial proposition: she learns what it is like to experience red. (shrink)

The paper proposes and defends the following characterization of response dependent property: a property is response-dependent iff there is a response-dependence biconditional for a concept signifying it which holds in virtue of the nature of the property. Finding out whether a property is such is to a large extent a posteriori matter. Finally, colors are response dependent: they are essentially tied to issuing the relevant experiences, so that having those experiences does give access to their, dispositional, nature. The author defends the naturalizing program of the notion of representation against the primitivist view according to which the notion of representation as belonging to psychology as a mature science is irreducible. First, the author concedes that the original teleological project trivializes the concept of representation by applying it to bacteria, protozoa, amoeba, when the best available explanation is the assumption that primitive organisms and artifacts are merely indicating proximal stimulation rather than representing the distal causes of stimulation. Yet, the (...) author does not believe that this presents an unsurmountable obstacle for the naturalizing program when what is in question is genuine sensory representation, namely perception. In the author’s view, what matters for the naturalizing program are not cases in which the concept of representation is misemployed, but rather cases in which the focus is genuine sensory representation, that is, genuine perceptions; or so he shall argue. Neste artigo, no intuito de nos inscrevermos em uma reflexão mais abrangente acerca dos negacionismos contemporâneos, com foco no “negacionismo histórico”, que se sustenta por processos de falseamento e homogeneização da história e das memórias, buscamos seguir o seguinte roteiro de reflexão analítica: i) tratar da escrita da história, abordando a produção de memórias, as políticas de esquecimento e o falseamento discursivo da história; ii) traçar um panorama acerca da escrita da história e da produção de memórias da ditadura civil-militar (...) brasileira, observando, de um lado, a produção discursiva nos campos escolar, jornalístico e “de história”, como formas de manifestação e promoção da memória oficial do regime, e, de outro, a construção das políticas institucionais de memória, com foco nas comissões de verdade, como mecanismos de instituição de regimes de dizibilidade sustentados por memórias-outras; iii) como eixo analítico-conclusivo, traçar uma reflexão que vai da negação da história à formação do autoritarismo contemporâneo, tomando como exemplo a violência contra os povos originários. Inscrevemo-nos, para dar cabo a esta discussão, na perspectiva arqueogenealógica dos Estudos Discursivos Foucaultianos, a partir da mobilização de um arcabouço teórico-metodológico que permite a análise dos processos de formação dos enunciados e dos discursos e, fundamentalmente, uma crítica reflexiva do presente. The will is one of the three pillars of the trilogy of mind that has pervaded Western thought for millennia, the other two being affectivity and cognition (Hilgard 1980). In the past century, the concept of will was imperceptibly replaced by the cognitive-oriented behavioral qualifiers “voluntary,” “goal-directed,” “purposive,” and “executive” (Tranel et al. 1994), and has lost much of its heuristic merits, which are related to the notion of “human autonomy” (Lhermitte 1986). We view catatonia as the clinical expression of (...) impairment of the brain mechanisms that promote human will. Catatonia is to the brain systems engaged in will, as coma is to the reticular ascending systems that promote sleep and wakefulness (Plum 1991). (shrink)

O uso de drogas é complexo e multicausal com impactos para as pessoas, famílias e sociedade. Este estudo investigou legislações, políticas públicas e estratégias, que possam diminuir vulnerabilidades e contribuir para os ODS. Foi realizado levantamento documental, em legislações e documentos, para análise da realidade social, a partir das experiências profissionais, e ainda levantamento bibliográfico, na BVS e LILACS, de 2016 a 2018. Observou-se que o Estado se mantém disciplinador e entre as políticas mais relevantes estão a Redução de Danos, (...) os CAPS e o Consultório de Rua, marcadas pelo empirismo, obstáculos e desafios em relação à universalidade e equidade. Estratégias intersetoriais, podem ser utilizadas para se obter melhores condições de saúde e bem-estar, saneamento e água, educação, trabalho. A promoção da saúde corrobora na redução das vulnerabilidades e equidade, com maior sensibilização e qualificação dos profissionais das redes de atenção social, para acolher a população com competência e dignidade.
